Map your degree to the specialty occupation standard
USCIS requires a direct connection between your degree field and your Business Development role. A marketing or international business degree strengthens your petition more than a general liberal arts credential. Pull your O*NET profile for the SOC code your employer will use before filing.
Target employers with active LCA filing history
Search Migrate Mate to filter Business Development roles by employers who have certified LCAs for this occupation. Prior filings signal an established H-1B process and reduce the risk of an employer starting from scratch with your petition.
Verify the wage level your employer will certify
Your offer must meet the DOL prevailing wage for your specific location and SOC code. Use the OFLC Wage Search to check Level I through Level IV wages before negotiating. A Level I offer in a high-cost metro can create RFE exposure if USCIS views the role as senior.
Document client-facing and strategic scope in your offer letter
Business Development titles face scrutiny because duties can overlap with sales, which USCIS sometimes treats as not requiring a specialty degree. Your offer letter should specify revenue strategy, partnership structuring, or market-entry analysis to distinguish the role from general sales work.
Check employer E-Verify enrollment before signing
All H-1B employers must be enrolled in E-Verify. Confirm enrollment status directly with HR during the offer stage. A non-enrolled employer cannot legally file your H-1B petition, and discovering this after accepting wastes your 60-day grace period.
H-1B Visa Business Development: Frequently Asked Questions
Does a Business Development role qualify as a specialty occupation for H-1B purposes?
Yes, if the position normally requires a bachelor's degree or higher in a specific field like business administration, marketing, international relations, or economics. USCIS looks at whether the degree requirement is standard for the role industry-wide, not just at your employer. Roles that accept any bachelor's degree regardless of field are harder to defend as specialty occupations.
How do I find Business Development employers who sponsor H-1B visas?
Search Migrate Mate, which filters Business Development roles by employers with verified LCA filing history. DOL publishes quarterly LCA disclosure data showing which companies have certified H-1B positions by SOC code, so you can identify employers who have sponsored this specific occupation rather than guessing based on company size or industry reputation.
Can my employer use a Business Development title for an H-1B if my actual duties are mostly sales?
This is a common RFE trigger. USCIS evaluates the actual job duties, not just the title. If the role involves cold outreach, quota-based selling, or account management without strategic or analytical components, USCIS may conclude it doesn't require a specialized degree. Your employer's I-129 must describe duties that go beyond transactional sales to hold up under scrutiny.
What happens to my H-1B if my Business Development role changes significantly after approval?
A material change in duties, location, or employer entity may require an amended H-1B petition. Moving to a new office in a different metropolitan statistical area, shifting from strategic partnerships to direct sales, or being acquired by another company can all trigger an amendment requirement. Your employer should consult immigration counsel before making those changes to avoid unauthorized employment risk.
Is Business Development a common H-1B occupation, and does that affect my lottery odds?
Business Development roles appear in H-1B filings across technology, finance, and healthcare sectors. The annual H-1B cap is 65,000 regular slots plus 20,000 for U.S. master's degree holders, with selection by lottery when registrations exceed those numbers. Having a U.S. master's degree in a relevant field increases your selection probability under the current two-round lottery structure.
