Verify your credential meets specialty occupation
H-1B approval requires a role tied to a specific bachelor's-level field. Pull the O*NET profile for Certified Nurse Aide and confirm your degree aligns with the listed knowledge domains before applying to sponsored positions.
Target employers with active LCA filing history
Search Migrate Mate to filter for healthcare employers who have filed Labor Condition Applications for CNA and nursing support roles. Employers with consistent LCA history are far more likely to sponsor than those filing for the first time.
Ask about E-Verify enrollment during offer negotiations
Federal contractors and most large healthcare systems are required to use E-Verify. Confirming your prospective employer is enrolled saves time after the H-1B is approved and signals they have experience onboarding sponsored workers.
Request the prevailing wage tier in writing
Use the OFLC Wage Search to look up the prevailing wage for your specific job title, SOC code, and work location. Your employer's LCA must certify at least that wage level, so knowing the tier before negotiating your offer protects your eligibility.
Prepare clinical documentation before the I-129 is filed
USCIS may issue a Request for Evidence asking for proof that the CNA role requires a specialized degree. Gather transcripts, credential evaluations, and any state-issued certifications so your employer's attorney can respond quickly if one arrives.

Find Certified Nurse Aide JobsCertified Nurse Aide H-1B Visa: Frequently Asked Questions
Does a Certified Nurse Aide role qualify as a specialty occupation for H-1B purposes?
It depends on how the employer defines the position. A standard CNA role that accepts any certificate holder typically does not meet the specialty occupation standard. Roles structured to require a bachelor's degree in nursing, health sciences, or a directly related field have a stronger case. The employer must document the degree requirement in the LCA and H-1B petition filed with USCIS.
Which types of employers sponsor H-1B visas for CNA roles?
Large hospital systems, long-term care networks, and federally qualified health centers are the most common sponsors because they have dedicated HR and legal infrastructure for immigration filings. Smaller private nursing homes rarely sponsor due to cost and administrative complexity. You can browse employers with verified LCA filing history for healthcare roles on Migrate Mate to narrow your search.
How does state CNA certification affect my H-1B timeline?
Your employer can begin the H-1B filing process before you complete state certification, but most facilities won't let you start work until your name appears on the state nurse aide registry. If your home-country training doesn't meet the state's competency exam requirements, plan for up to 90 days to complete the testing and registration process after you arrive.
Can my employer file the H-1B petition before I pass the state competency exam?
Yes. USCIS adjudicates the H-1B petition based on degree requirements and the specialty occupation standard, not state licensure status. Your employer files Form I-129 and the certified LCA independently of your state registry status. You'll need the state certification in place before your first patient care shift, but it doesn't block the federal petition from moving forward.
What happens to my H-1B status if my CNA certification lapses or my state registration expires?
Letting your state certification lapse while on H-1B status creates a compliance problem for your employer. The LCA and H-1B petition are tied to a specific role and worksite. If you can no longer legally perform CNA duties due to a lapsed credential, your employer must stop assigning you patient care work and notify USCIS of any material change in employment conditions.
