Verify your degree field supports specialty occupation
COO petitions face RFE risk when the degree field appears unrelated to operations management. Cross-reference your credentials against the O*NET occupation profile for Chief Executives to confirm your educational background aligns with USCIS specialty occupation standards.
Target employers with cap-exempt H-1B filing history
Universities, nonprofits affiliated with research institutions, and government-related entities file H-1B petitions outside the annual cap. COO roles at these organizations skip the lottery entirely, giving you a clear path to sponsorship without the April registration window pressure.
Search verified H-1B sponsors on Migrate Mate
Filter COO openings by employers with confirmed LCA filing history on Migrate Mate. This surfaces companies that have sponsored similar executive roles before, so you're not cold-pitching sponsorship to HR teams unfamiliar with the process.
Negotiate prevailing wage compliance before signing an offer
Your employer's LCA must certify your compensation meets the DOL prevailing wage for your specific location and job zone. Run the OFLC Wage Search for SOC code 11-1021 before finalizing your offer letter to confirm the proposed salary clears the threshold.
Request premium processing for executive-level petitions
USCIS offers 15-business-day adjudication through premium processing. For COO hires, employers typically absorb this cost given seniority, and it eliminates uncertainty during notice periods, board approvals, or investor due diligence tied to leadership transitions.
Document operational scope to satisfy specialty occupation scrutiny
USCIS increasingly audits COO petitions where the role description overlaps with general management. Work with your employer to build a job description that ties day-to-day duties to specific technical or specialized knowledge, not just oversight responsibilities.

Find Chief Operating Officer JobsChief Operating Officer H-1B Visa: Frequently Asked Questions
Does a Chief Operating Officer role qualify as a specialty occupation for H-1B purposes?
Yes, provided the role requires at least a bachelor's degree in a specific field such as business administration, operations management, or engineering. USCIS applies heightened scrutiny to executive titles because the duties can appear general. Your employer's petition needs to connect the COO's specific responsibilities to a directly related degree field, not just business broadly.
Which industries most actively sponsor H-1B visas for COO positions?
Technology, healthcare systems, manufacturing, and financial services file the highest volume of H-1B LCAs for senior operations roles. These sectors have complex, cross-functional operations that justify specialized executive leadership. You can identify employers with active sponsorship history for COO-level roles by searching Migrate Mate, which filters by verified LCA filings.
Can an H-1B holder change employers to take a COO role mid-petition year?
Yes. H-1B portability lets you start working for a new employer as soon as the new I-129 petition is filed, not after it's approved, as long as your previous H-1B was approved and you haven't been out of status. Your new employer files the petition and you can transition immediately, which matters when a COO offer moves quickly through board approval.
How does the H-1B cap lottery affect executive-level candidates seeking COO roles?
COO roles at for-profit employers are cap-subject, meaning your employer must register you in USCIS's annual lottery each March. Cap-exempt employers including universities, nonprofit research institutions, and affiliated entities are not subject to the lottery. If you're targeting for-profit companies, the annual cap deadline and lottery selection rate are factors to plan your job search timeline around.
What documentation does an employer typically need to sponsor an H-1B for a COO?
Your employer files a certified LCA with DOL, then submits Form I-129 to USCIS with supporting evidence that the COO role qualifies as a specialty occupation. That evidence includes a detailed job description, organizational chart showing where the COO sits, and documentation of the business need for a degree-level hire. Your own credentials, transcripts, and any equivalency evaluations are submitted alongside.
