Verify your degree supports specialty occupation
USCIS requires that a Contract Recruiter role demands at least a bachelor's degree in a specific field. Pull the O*NET profile for this occupation to confirm the typical education requirements before an employer questions your petition.
Target employers with active LCA filings
Search OFLC disclosure data for employers who have certified LCAs under job titles like Recruiter, Talent Acquisition Specialist, or HR Consultant. Consistent filing history signals a real sponsorship infrastructure, not a one-time exception.
Find H-1B sponsoring employers on Migrate Mate
Filter Contract Recruiter openings on Migrate Mate by verified H-1B LCA filing history. This shows you which employers have actually sponsored the role before, so you're not guessing based on company size or reputation.
Clarify whether the role is contract or direct hire
H-1B sponsorship requires an employer-employee relationship. If a staffing agency places you at a client site, the agency, not the client, must file the petition and maintain control over your work. Confirm this structure in writing before accepting an offer.
Request prevailing wage documentation before offer acceptance
Ask the employer to share the wage level from their OFLC Wage Search lookup for your job title and location. If the offered salary falls below Level I or II for your area, the LCA cannot be certified and the petition will stall.
Account for the 60-day grace period when switching roles
If your current H-1B ends or your employer terminates you, USCIS allows a 60-day grace period to find a new sponsor. A new employer must file a transfer petition before that window closes for you to maintain lawful status.

Find Contract Recruiter JobsContract Recruiter H-1B Visa: Frequently Asked Questions
Does a Contract Recruiter role qualify as a specialty occupation for H-1B purposes?
It can, but it depends on how the employer defines the role. USCIS requires the position to normally require a bachelor's degree in a specific field such as human resources, business administration, or organizational psychology. Generic recruiting roles that accept any degree may face a Request for Evidence. Roles with specialized scope, such as technical recruiting or workforce strategy, strengthen the specialty occupation argument.
Can a staffing agency sponsor my H-1B for a Contract Recruiter placement?
Yes, staffing agencies can sponsor H-1B workers, but USCIS scrutinizes these arrangements closely. The agency must be your legal employer of record, pay your wages directly, and maintain the right to control your work. A client company cannot file the petition on your behalf. Make sure the agency has a certified LCA in place before you start working, and confirm the end-client site is listed in the filing.
How do I find employers who have actually sponsored H-1B visas for Contract Recruiter roles before?
DOL publishes LCA disclosure data that shows every employer who has filed for H-1B workers by job title and location. Migrate Mate surfaces this data directly in its job search, so you can filter Contract Recruiter listings by verified H-1B filing history rather than relying on job descriptions that mention sponsorship without evidence.
What happens to my H-1B status if my contract recruiter placement ends early?
If the staffing agency terminates your placement before your H-1B period expires, your status ends with it. USCIS provides a 60-day grace period for you to find a new sponsoring employer and file an H-1B transfer petition. The new employer can file under portability rules, letting you start working once the receipt notice is issued, without waiting for full approval.
Does working as a Contract Recruiter on H-1B count toward permanent residency eligibility?
Yes, H-1B time in status counts toward your U.S. work history and can support a future green card application. Employers sponsoring Contract Recruiters for permanent residency typically file under the EB-2 or EB-3 category, which requires a PERM labor certification unless the role qualifies for a National Interest Waiver. Your employer's HR or immigration counsel initiates that process separately from the H-1B.
