Get Access To All JobsTips for Finding H-1B Visa Sponsorship as a Data Science Analyst
Map your degree to the LCA
Your degree field must directly tie to the Data Science Analyst role your employer describes. A mismatch between your transcript and the job duties is a common RFE trigger, so document the connection before your employer files.
Check prevailing wage before accepting offers
Use the OFLC Wage Search to look up the Level I through Level IV wage for your SOC code and work location. Your offered salary must meet the certified LCA wage or USCIS will deny the petition.
Target E-Verify enrolled employers early
STEM OPT employers must be E-Verify enrolled, and that same enrollment signals an established sponsorship infrastructure. Filter your search to E-Verify participants so you're not starting from scratch with an employer who has never filed.
Search H-1B filing history on Migrate Mate
Pull DOL Labor Condition Application data by employer and occupation code on Migrate Mate to see which companies have actually filed for Data Science Analyst roles, not just which ones say they sponsor.
Time your lottery registration around OPT cap-gap
If you're on OPT when the lottery closes in March, your cap-gap extends work authorization through September 30 if you're selected. Confirm your OPT end date against that window before deciding whether to request premium processing.
Request a specialty occupation support letter
Ask your employer to prepare a detailed support letter explaining why the Data Science Analyst role requires a degree in a specific field, not just any bachelor's. USCIS scrutinizes analyst titles more than engineering titles, so specificity in that letter reduces RFE risk.
H-1B Visa Data Science Analyst: Frequently Asked Questions
Does a Data Science Analyst role qualify as an H-1B specialty occupation?
Yes, provided the employer can demonstrate the position requires at least a bachelor's degree in a specific field such as statistics, mathematics, computer science, or data science. USCIS evaluates the actual job duties, not just the title. Roles that accept any bachelor's degree regardless of field are the ones most likely to receive an RFE or denial on specialty occupation grounds.
How do I find employers who have sponsored H-1B visas for Data Science Analyst roles specifically?
Search Migrate Mate using the Data Science Analyst occupation code to see employer LCA filing history filtered to that role. This shows you which companies have gone through the DOL certification process for this specific job title, not just which employers sponsor H-1B visas in general. That distinction matters because sponsorship willingness varies significantly by role within the same company.
What happens to my H-1B if my employer changes my job duties significantly after filing?
A material change in job duties, location, or employer can require an amended I-129 petition. If the new duties shift you outside the specialty occupation description certified in the original LCA, your employer must file a new LCA and an amended petition before the change takes effect. Working under materially changed conditions without an amended filing creates status risk.
Can I work for multiple employers as a Data Science Analyst on H-1B?
Yes, through concurrent H-1B employment. Each employer must file a separate I-129 petition and a separate LCA certified at the prevailing wage for that work location. You cannot begin work for the second employer until USCIS approves their petition. Consulting arrangements where you're placed at client sites may require additional scrutiny of the employer-employee relationship.
How does the H-1B prevailing wage requirement work for Data Science Analyst positions?
Your employer must certify through DOL that your offered wage meets or exceeds the prevailing wage for the Data Science Analyst occupation in your work location. Prevailing wage is determined by the SOC code, geographic area, and wage level, which corresponds roughly to your experience and responsibilities. You can verify the applicable wage tier using the OFLC Wage Search before evaluating any offer.
