H-1B Visa HR Consultant Jobs
HR Consultant roles qualify for H-1B visa sponsorship as specialty occupations requiring at least a bachelor's degree in human resources, business administration, or a related field. Many mid-size and enterprise employers file H-1B petitions for HR Consultants, particularly in workforce planning, compensation, and HRBP functions. Cap-subject petitions must be filed by April 1 for an October 1 start date.

Align your credentials to SOC codes
HR Consultant roles map to multiple SOC codes, and the one your employer selects affects your prevailing wage tier. Check O*NET to confirm whether your duties align with Human Resources Specialists or Management Analysts before your employer files the LCA.
Verify the prevailing wage before accepting offers
Use the OFLC Wage Search to look up Level I through Level IV wages for your target SOC code and metro area. If an offer falls below the applicable prevailing wage, USCIS will deny the petition regardless of your qualifications.
Target employers with cap-exempt filing history
Consulting firms that hold contracts with universities or government agencies may qualify as cap-exempt entities, letting you start without waiting for the October 1 lottery window. Ask during screening calls whether the employer has cap-exempt status.
Search H-1B sponsors on Migrate Mate
Filter by HR Consultant roles on Migrate Mate to see which employers have active LCA filings for this occupation. That filing history confirms the employer understands the H-1B process and has sponsored similar positions before.
Negotiate premium processing into your offer
Standard I-129 adjudication can extend your job start date by months. Request that your employer elect USCIS premium processing so the petition is adjudicated within 15 business days, reducing gap risk if you're transferring from another employer.
Document your HR Consultant duties precisely for the LCA
Vague job descriptions are a common source of H-1B RFEs in HR roles. Work with your employer to ensure the LCA and I-129 support letter describes duties requiring specialized HR knowledge, not generalist tasks that don't require a degree in a specific field.
H-1B Visa HR Consultant: Frequently Asked Questions
Does an HR Consultant role qualify as a specialty occupation for H-1B purposes?
Yes, provided the position genuinely requires at least a bachelor's degree in human resources, business administration, industrial-organizational psychology, or a directly related field. Generalist HR roles where any degree is accepted regardless of field can face USCIS RFEs. Roles focused on compensation analysis, organizational development, or workforce strategy are more defensible than broad HR generalist positions.
Which employers sponsor H-1B visas for HR Consultants?
Large consulting firms, multinational corporations with dedicated HRBP functions, and HR technology companies are the most active sponsors. Mid-size employers in professional services, healthcare, and financial services also file regularly. Migrate Mate shows verified LCA filing history by occupation, so you can identify which employers have sponsored HR Consultant roles rather than relying on job postings alone.
Can I transfer my H-1B to a new HR Consulting employer mid-year?
Yes. Under H-1B portability rules, you can start working for a new employer as soon as the new I-129 petition is filed with USCIS, without waiting for approval, as long as you've been maintaining valid H-1B status. The new employer files a transfer petition and an accompanying LCA certified by DOL for the new worksite location and wage level.
How does a consulting firm's client-site arrangement affect my H-1B?
If you'll be placed at a client site, your employer must file a separate LCA for each client location where you'll work more than 60 workdays per year. The prevailing wage is determined by the client's physical location, not the consulting firm's headquarters. USCIS scrutinizes third-party placement arrangements, so your employer should document that they control your day-to-day HR work.
What happens to my H-1B status if my HR Consulting project ends between assignments?
Your employer must continue paying your full salary during any non-productive periods caused by lack of work, known as the benching rule. If the employment relationship ends, you have a 60-day grace period to find a new employer and file a transfer petition, change status, or depart the country. Do not let this window lapse without taking action.
