Verify your MSW meets specialty occupation standards
USCIS requires that the role normally requires a master's in social work or a directly related field. Check the O*NET profile for Medical Social Workers to confirm the degree requirement language before applying.
Target health systems with existing LCA filings
Hospitals and integrated health networks file LCAs repeatedly for clinical social worker roles. Search LCA disclosure data on the OFLC Wage Search to identify employers who have sponsored this exact job title before.
Get your NASW credential and state licensure ready early
Many hospital employers require LCSW or LMSW licensure as a condition of the H-1B petition. Confirm your state license is active before offer negotiations, since USCIS evaluates licensure as part of specialty occupation evidence.
Use Migrate Mate to filter verified H-1B sponsors
Migrate Mate surfaces employers with confirmed LCA filing history for Medical Social Worker roles, so you're not cold-applying to employers who've never sponsored. Filter by specialty, location, and filing recency to focus your search.
Clarify whether your offer is cap-subject or cap-exempt
Nonprofits affiliated with hospitals or universities may qualify as cap-exempt employers under INA Section 214(g)(5), meaning your petition skips the annual lottery. Ask HR whether the entity files as cap-exempt before accepting an offer.
Confirm your employer's prevailing wage tier before signing
DOL assigns Medical Social Worker wages across four levels. Your offer must meet or exceed the Level I through IV wage posted on the certified LCA. Cross-check the wage tier against your actual duties so the LCA accurately reflects your role.
H-1B Visa Medical Social Worker: Frequently Asked Questions
Does a Medical Social Worker role qualify as an H-1B specialty occupation?
Yes. USCIS classifies Medical Social Worker as a specialty occupation because the position normally requires at least a master's degree in social work. A general bachelor's degree does not meet the threshold. Your employer's H-1B petition must document that the specific role requires an MSW or equivalent graduate-level credential in a directly related field.
Which employers sponsor H-1B visas for Medical Social Workers?
Large hospital systems, academic medical centers, VA facilities, and nonprofit health organizations are the most active sponsors for this role. Cap-exempt entities such as university-affiliated hospitals can file outside the annual lottery window. Migrate Mate lets you search employers by H-1B filing history for Medical Social Worker positions so you can prioritize sponsors with a track record.
Does state licensure affect my H-1B petition as a Medical Social Worker?
Yes, significantly. Many employers and states require an LMSW or LCSW license to practice independently, and USCIS may treat an active state license as supporting evidence of specialty occupation. If your license is from another state, verify reciprocity rules early. Some employers will not initiate an H-1B petition until you hold a valid license in the state where you'll work.
Can a nonprofit hospital sponsor my H-1B without the lottery?
It depends on how the entity is classified. Nonprofits that are affiliated with a university or are designated as a nonprofit research organization under INA Section 214(g)(5) qualify as cap-exempt employers. That means USCIS can adjudicate the petition any time of year, bypassing the April lottery entirely. Confirm the employer's cap-exempt status with HR before assuming you're outside the cap.
What prevailing wage level applies to Medical Social Worker H-1B positions?
DOL assigns wages at four levels based on experience, supervision, and complexity of duties. Entry-level clinical roles typically fall at Level I or II, while senior or supervisory positions may reach Level III or IV. Your employer sets the wage level when filing the LCA. Use the OFLC Wage Search to look up the prevailing wage for your specific job title, location, and assigned level before your offer is finalized.
