Verify your degree meets specialty occupation
USCIS requires your degree field to directly relate to the Mental Health Worker role. A general social work or psychology degree typically qualifies, but a business or unrelated degree paired with clinical experience rarely satisfies the specialty occupation standard.
Check prevailing wage tiers before negotiating
Use the OFLC Wage Search to look up the prevailing wage for your job title, state, and experience level before any offer discussion. Your employer's LCA must certify a wage at or above that threshold, so knowing the floor protects you.
Target employers with active LCA filing history
Search Migrate Mate to filter Mental Health Worker roles by employers who have certified LCAs in your target location. This confirms the employer has already navigated the DOL filing process and is set up to sponsor.
Flag state licensure requirements early in hiring
Most states require a Licensed Clinical Social Worker or Licensed Professional Counselor credential to practice independently. Raise your licensure status upfront with hiring managers since some employers won't initiate H-1B filing for unlicensed candidates in clinically supervised roles.
Confirm cap-subject filing timelines with HR
If your prospective employer isn't a nonprofit, university, or government entity, your H-1B petition falls under the annual cap with an April filing window. Ask HR explicitly whether they participate in the lottery and whether they'll file premium processing to meet your start date.
Document supervised clinical hours for RFE defense
USCIS sometimes issues Requests for Evidence questioning whether Mental Health Worker roles genuinely require a specialty degree. Compile letters from supervisors, your job description, and any credentialing requirements from your state licensing board before your employer files.

Find Mental Health Worker JobsMental Health Worker H-1B Visa: Frequently Asked Questions
Do Mental Health Worker jobs qualify for H-1B sponsorship?
Yes, if the role requires at least a bachelor's degree in a specific field such as psychology, clinical social work, or counseling. Roles where any degree is accepted regardless of field typically fail the specialty occupation test. Employers confirm the degree requirement in the LCA they file with DOL before submitting your H-1B petition to USCIS.
Which types of employers sponsor H-1B visas for Mental Health Workers?
Hospitals, federally qualified health centers, behavioral health organizations, and academic medical centers are among the most consistent H-1B sponsors in this field. Nonprofit healthcare employers and universities are also cap-exempt, meaning they can file outside the annual lottery window and at any time of year. You can filter for these employers by LCA history on Migrate Mate.
Does my state license affect my H-1B eligibility as a Mental Health Worker?
Licensure doesn't directly determine H-1B eligibility, but it affects your ability to practice in the role. Many employers require a state license before they'll complete onboarding, and some won't sponsor H-1B petitions for candidates who aren't yet licensed or eligible to sit for licensure. Check your state's clinical social work or counseling board requirements before applying.
How does the H-1B cap apply to Mental Health Worker roles?
Most for-profit behavioral health employers are cap-subject, meaning H-1B petitions must be filed during the April registration window with an October 1 start date if selected. Nonprofit hospitals, government-run mental health agencies, and university-affiliated clinics are cap-exempt and can file year-round. Confirming your prospective employer's cap status before accepting an offer is essential for timeline planning.
What does the O*NET classification mean for my H-1B petition?
O*NET categorizes Mental Health Workers under several occupation codes depending on your specific duties, including social and human service assistants, mental health counselors, and substance abuse counselors. Your employer uses the O*NET code to select the correct Standard Occupational Classification code on the LCA, which then determines the prevailing wage tier USCIS and DOL apply to your petition.
