Verify your MSN or DNP meets specialty occupation
USCIS requires a directly related degree for specialty occupation classification. Your MSN or DNP in family, adult-gerontology, or primary care NP programs satisfies this. A general nursing BSN alone does not support an H-1B petition for an NP role.
Check state licensure requirements before accepting offers
H-1B approval depends partly on your ability to legally practice. Confirm the state grants NP full practice authority or requires physician collaboration, then verify your APRN license or compact privilege covers the work location before your employer files.
Target federally qualified health centers for sponsorship
FQHCs and rural health clinics frequently sponsor H-1B NPs because federal designation creates workforce incentives. Search Migrate Mate to filter for employers with verified H-1B LCA filing history in primary care NP roles specifically.
Request the LCA wage level before signing your offer
Your employer files a Labor Condition Application with DOL certifying your wage meets the prevailing level for your location and job code. Ask which wage level (I through IV) they're filing at. Wage Level II or III reflects most mid-career NP placements.
Use OFLC Wage Search to benchmark your offer's prevailing wage
Look up SOC code 29-1171 (Nurse Practitioners) in the OFLC Wage Search for your metro area. If your offered salary falls below the Level I prevailing wage, USCIS can issue an RFE or DOL can disallow the LCA certification entirely.
File H-1B before OPT or grace period expires if transitioning
If you're moving from F-1 OPT to H-1B, your employer must file by April 1 for an October 1 start. NP roles often require license verification that takes weeks, so start the credentialing and USCIS petition process at least five months before your OPT end date.
H-1B Visa Primary Care Nurse Practitioner: Frequently Asked Questions
Does a Primary Care Nurse Practitioner role qualify as a specialty occupation for H-1B purposes?
Yes. USCIS classifies Nurse Practitioner positions as specialty occupations because the role requires at minimum a Master of Science in Nursing or Doctor of Nursing Practice in a related clinical specialty. A general RN license or a BSN without an advanced practice degree is not sufficient to support the petition. Your employer's LCA must reflect the NP job code, not a general staff nurse classification.
Which types of employers most commonly sponsor H-1B visas for primary care NPs?
Federally qualified health centers, large hospital-owned primary care networks, and multispecialty physician groups file the most H-1B LCAs for NP roles. Rural health clinics and community health organizations also sponsor regularly because federal designation creates hiring flexibility. You can search Migrate Mate to see employers with verified LCA filing history for Nurse Practitioner positions in your target location.
Does state scope-of-practice law affect my H-1B petition as a primary care NP?
It can. USCIS reviewers examine whether you're licensed to perform the duties described in the petition. In states requiring physician collaboration agreements, your offer letter and petition should reflect that structure accurately. If you hold a compact APRN license, confirm it covers the specific work state before your employer files, as an invalid license can trigger an RFE.
Can my H-1B employer change my clinic location after approval?
Yes, but only within limits. H-1B is location-specific: if you move to a worksite in a different metropolitan statistical area, your employer must file an amended H-1B petition with a new LCA reflecting the new location's prevailing wage. Short-term placements under 60 days may qualify for a short-placement exception, but routine reassignment to a different city requires an amendment before the move.
What happens to my H-1B status if my sponsoring employer loses its federal health center designation or closes a clinic?
Your H-1B status is tied to that specific employer. If the organization terminates your employment or the worksite closes, you enter a 60-day grace period to find a new H-1B sponsor, change status, or depart. A new employer must file an H-1B transfer petition before that window closes. Start identifying backup sponsoring employers with active LCA histories as soon as your employment situation becomes uncertain.
