Verify your state teaching license transfers
H-1B approval requires a valid state teaching license before USCIS will certify the specialty occupation. If your credential was issued in another state, confirm reciprocity with your target state's board of education before accepting an offer.
Target public school districts directly
Most public school districts qualify as government entities exempt from the H-1B cap, so your petition skips the annual lottery. Search Migrate Mate to filter for districts with active H-1B filing history in special education roles.
Confirm the prevailing wage tier before signing
Your employer's LCA must certify a wage at or above the DOL prevailing wage for your specific special education role and county. Run the OFLC Wage Search using SOC code 25-2050 to verify the wage level before your offer letter is finalized.
Document your IEP experience in your petition
USCIS adjudicators look for evidence that the role genuinely requires a specialized degree. Attach a detailed job duties letter from your employer that explicitly ties Individualized Education Program development to your specific degree field, not just general teaching experience.
Ask whether the district uses a pooled attorney
Many large school districts retain a single immigration law firm to handle all H-1B filings district-wide. Knowing this early tells you who controls the petition timeline and prevents miscommunication between HR, the principal, and outside counsel.
Check the O*NET profile before your interview
The O*NET occupation profile for special education teachers lists the degree and knowledge requirements USCIS references when evaluating specialty occupation. Align your resume and interview answers to the competencies listed there to strengthen the petition's factual basis.
H-1B Visa Middle School Special Education Teacher: Frequently Asked Questions
Does a middle school special education teacher role qualify as a specialty occupation for H-1B purposes?
Yes. USCIS classifies special education teaching as a specialty occupation because it normally requires a bachelor's degree or higher in special education or a directly related field. Most states also require a specific special education credential or endorsement, which reinforces the degree-relatedness standard USCIS uses to evaluate the petition.
Are public school districts subject to the H-1B cap and annual lottery?
Most public school districts are government entities or affiliated nonprofits that qualify as cap-exempt employers, meaning your H-1B petition bypasses the annual lottery and the 65,000 regular-cap slots. You can file at any time of year and expect a faster adjudication timeline. Confirm cap-exempt status with the district's HR or legal team before relying on it.
How do I find middle school special education teaching jobs where employers sponsor H-1B visas?
Search Migrate Mate to find middle school special education teaching roles at employers with verified H-1B LCA filing history. Filtering by employers who have previously filed for special education roles saves time and surfaces districts that already understand the sponsorship process, reducing the risk of an employer backing out once they see the paperwork requirements.
What happens to my H-1B status if my teaching contract ends at the close of the school year?
If your district does not renew your contract, you have a 60-day grace period from your employment end date to find a new H-1B employer, transfer your petition, or change to another visa status. During this window you cannot legally work, but you remain in valid status. Act immediately, as the 60-day period does not extend for weekends or holidays.
Does my employer need to complete any additional verification steps beyond the H-1B filing?
Yes. School districts that employ H-1B workers must complete I-9 employment eligibility verification and, if they receive federal contracts, may be required to use E-Verify. The district must also post the certified LCA notice at the work site for ten consecutive business days before USCIS will approve the petition, which is a step some HR departments overlook.
