Verify your degree meets specialty occupation
USCIS requires your degree field to directly relate to nuclear engineering work. A degree in mechanical or electrical engineering may qualify if your coursework covers nuclear systems. Pull your transcripts and map relevant coursework before applying.
Target NRC-licensed facilities in your search
Commercial nuclear power plants, national laboratories like Argonne and Oak Ridge, and defense contractors with NRC licensing file LCAs regularly. Use Migrate Mate to filter employers by verified H-1B filing history in nuclear engineering roles.
Check prevailing wage before negotiating offers
Your employer's LCA must certify a wage at or above the DOL prevailing wage for your job title and work location. Run your role and ZIP code through the OFLC Wage Search before you receive an offer so you can negotiate from an informed position.
Confirm security clearance compatibility early
Many nuclear engineering roles at federal facilities require security clearances that H-1B holders may not be eligible for as foreign nationals. Ask hiring managers directly whether the role is open to non-citizens before investing time in the interview process.
Request premium processing if your start date is fixed
USCIS standard processing can run several months. If your employment start date is tied to a facility outage schedule, reactor commissioning, or a project milestone, ask your employer to file with premium processing to get a decision within 15 business days.
Get your O*NET classification documented before filing
The O*NET profile for Nuclear Engineers supports the specialty occupation argument your employer needs for the I-129 petition. Share that classification with your employer's attorney early so it's referenced correctly in the petition's support letter.
H-1B Visa Nuclear Engineer: Frequently Asked Questions
Does a nuclear engineering role qualify as an H-1B specialty occupation?
Yes. Nuclear engineering consistently meets the H-1B specialty occupation standard because the work normally requires at least a bachelor's degree in nuclear engineering or a directly related field. The O*NET profile for Nuclear Engineers places the role in Job Zone 5, which USCIS treats as strong evidence of specialty occupation status. Your employer documents this in the I-129 petition's support letter.
Which types of employers sponsor H-1B visas for nuclear engineers?
Active sponsors include commercial nuclear utilities, national laboratories operated under DOE contracts, nuclear consulting and engineering firms, and defense contractors with nuclear programs. These employers file Labor Condition Applications with DOL, which creates a public record of their sponsorship activity. You can browse employers with verified H-1B filing history for nuclear engineering roles on Migrate Mate.
Can I work at a nuclear facility on H-1B status if the role requires a security clearance?
Some nuclear roles at federal facilities require security clearances that are restricted to U.S. citizens or lawful permanent residents, making them unavailable to H-1B holders. Commercial reactor operators and private nuclear engineering firms often have roles without that restriction. Confirm clearance requirements directly with the employer before submitting an application, since it affects whether sponsorship is viable for that specific position.
How does the H-1B cap lottery affect nuclear engineers?
Most nuclear engineering positions are with cap-subject employers, meaning the petition enters the annual H-1B lottery capped at 85,000 visas. However, positions at qualifying nonprofit research organizations, government research institutions, or universities may be cap-exempt. USCIS defines the exemption criteria. If your target employer is cap-subject, registration opens each March for an October 1 start date.
What wage level should I expect on my LCA as a nuclear engineer?
Your employer's LCA must certify a wage at or above the DOL prevailing wage for your job title, experience level, and work location. Nuclear engineering prevailing wages vary significantly between regions, with facilities near major reactor sites or national laboratories often posting at higher wage levels. Run your specific role and location through the OFLC Wage Search to see the applicable wage tier before your offer is finalized.
