Verify your degree supports specialty occupation
Personal Assistant roles face more H-1B scrutiny than technical jobs because USCIS must confirm the position requires a specific bachelor's degree. Review your offer letter to ensure the job description explicitly lists a degree requirement in business, communications, or a related field.
Target employers with LCA filing history
Use Migrate Mate to filter Personal Assistant openings by employers who have filed Labor Condition Applications for this occupation code. Employers with documented LCA history have already cleared the DOL certification step and understand the sponsorship process.
Pull prevailing wage data before negotiations
Look up the wage level for your target metro area using the OFLC Wage Search before your offer stage. Your employer's LCA must certify they'll pay at least the prevailing wage for your location and experience level, so knowing Level I versus Level II rates shapes your negotiation.
Check the O*NET profile to strengthen your petition
The O*NET occupation profile for Personal Assistants lists education and skill requirements your employer can cite in the I-129 petition. A detailed job duties letter tied to O*NET's specialty occupation language reduces the chance of a Request for Evidence from USCIS.
Confirm E-Verify enrollment before accepting an offer
Ask HR whether the company is enrolled in E-Verify before signing. Employers who haven't used E-Verify before may not realize it's required once you're on H-1B status, and discovering this gap after your start date creates avoidable compliance risk for both parties.
Time your petition to the 60-day cap-gap window
If you're transitioning from OPT, your employer's I-129 must be filed and received by USCIS before your EAD expires. Filing late means a gap in work authorization, so align your offer acceptance and start date to give your employer enough lead time to file.
H-1B Visa Personal Assistant: Frequently Asked Questions
Do Personal Assistant jobs qualify for H-1B sponsorship?
They can, but qualification isn't automatic. USCIS requires the role to meet the specialty occupation standard, meaning the position must normally require at least a bachelor's degree in a specific field directly related to the duties. PA roles at large corporations or executive offices are more defensible than general administrative assistant positions where any degree is accepted.
How do I find Personal Assistant jobs with H-1B sponsorship?
Search Migrate Mate to find Personal Assistant openings filtered by employers with verified LCA filing history. This shows you companies that have already filed with the DOL for this occupation, which is a strong signal they're willing and able to sponsor. It's more reliable than guessing from job postings that say 'sponsorship available.'
What makes a Personal Assistant role harder to sponsor than an engineering job?
USCIS adjudicators apply stricter scrutiny to business and administrative roles because the specialty occupation standard is less obvious than for STEM fields. Your employer needs to document why the specific duties require a degree in a particular discipline, not just any bachelor's degree. A well-drafted support letter from the employer that maps your degree field to the job duties is essential.
Can my employer file an H-1B for me if they've never sponsored before?
Yes, but first-time sponsors carry more risk. They'll need to register with USCIS, file an LCA with the DOL, and submit the I-129 petition correctly. Many first-time sponsors underestimate the timeline or documentation required. Confirm early whether they have immigration counsel and budget for the filing, since employer fees can't be passed to the employee.
What H-1B occupation code applies to Personal Assistant roles?
Personal Assistants typically fall under Standard Occupational Classification codes for administrative and executive secretaries or management analysts, depending on the actual duties. The correct SOC code determines which prevailing wage level applies on the LCA. Confirm the SOC code with your employer before the LCA is filed, since an incorrect classification can trigger a DOL audit or RFE from USCIS.
