Align your degree to the SOC code
Presales Solution Architect roles are typically filed under SOC 15-1299 or 15-1252. Pull the O*NET profile for your target code and confirm your degree field matches. A mismatch is one of the most common RFE triggers for this title.
Filter employers by LCA filing history
Use Migrate Mate to identify companies that have filed LCAs specifically for solution architect or presales titles. Employers with a documented filing pattern are far more likely to have internal immigration counsel and established H-1B processes already in place.
Request the prevailing wage before negotiating
Run your target job location and SOC code through the OFLC Wage Search before you discuss compensation. Your offered salary must meet at least the DOL prevailing wage for Level I through Level IV, and knowing the floor protects you during offer negotiation.
Document your technical advisory work precisely
USCIS scrutinizes presales roles because the job blends sales and engineering. Your resume and support letter should quantify technical deliverables, such as proof-of-concept designs or architecture assessments, not sales outcomes, to establish specialty occupation clearly.
Confirm vendor certifications count toward equivalency
If you hold a three-year bachelor's degree or lack a directly related degree, professional certifications from AWS, Azure, or Google Cloud can support an equivalency argument. Your employer's immigration attorney needs to document how certifications combine with experience to meet the bachelor's-equivalent standard.
Start the LCA filing at least 30 days before your cap-gap expires
DOL must certify the LCA before USCIS can accept Form I-129. Employers routinely underestimate this sequencing. If you're in a cap-gap period, confirm your employer has initiated the LCA with DOL at least 30 days before your OPT end date.
H-1B Visa Presales Solution Architect: Frequently Asked Questions
Does a Presales Solution Architect role qualify as a specialty occupation for H-1B purposes?
Yes, if the position requires at least a bachelor's degree in a directly related field such as computer science, information systems, or electrical engineering. The challenge is that presales roles involve client-facing work, so the job description must emphasize technical responsibilities like solution design and architecture rather than sales quotas. USCIS will review the actual duties, not just the title.
Which SOC code do employers typically use when filing an H-1B for this role?
Most employers file under SOC 15-1299 (Computer Occupations, All Other) or SOC 15-1252 (Software Developers and Software Quality Assurance Analysts and Testers), depending on the technical focus of the role. The SOC code determines the prevailing wage level, so confirming the correct code with your employer before the LCA is filed directly affects your compensation floor.
How do I find employers who actively sponsor H-1B visas for Presales Solution Architect positions?
Migrate Mate surfaces employers with verified LCA filing history for solution architect and presales titles, so you can focus your applications on companies that have already navigated the H-1B process for this role type. Targeting employers with a filing track record reduces the risk of an offer falling through because legal counsel is unfamiliar with sponsoring technical presales positions.
Can I transfer my H-1B to a new employer if I switch presales roles mid-employment?
Yes, H-1B portability under AC21 lets you start working for a new employer once they file a new I-129 petition, as long as your previous H-1B was approved and you've been in valid status for at least 180 days. The new employer must file a separate LCA for the new role and location, even if the job title is identical to your previous position.
What happens if my Presales Solution Architect role involves frequent travel to different client sites?
USCIS requires a certified LCA for each worksite location where you'll work for more than 30 continuous days. For short-term placements at client sites, a short-term placement exception may apply, but it's limited to 60 days per year in any single location. Your employer should file location-specific LCAs for any sustained client engagements in states outside your primary work address.
