Frame your QA credentials around specialty occupation
USCIS scrutinizes whether a QA role truly requires a degree, not just prefers one. Document how your testing work demands theoretical knowledge, test architecture, risk modeling, or systems validation, not just manual click-through tasks.
Target employers with active LCA filing history
Use Migrate Mate to filter QA Tester roles by employers who have filed Labor Condition Applications for this occupation code. Filing history signals a genuine sponsorship infrastructure, not a one-off promise from a recruiter.
Verify the prevailing wage tier before accepting an offer
Run your job title and location through the OFLC Wage Search to confirm which wage level applies. Employers must certify your offered salary meets at least Level I, a mismatch causes LCA rejection before the H-1B petition is even filed.
Check the O*NET profile to strengthen your petition
The O*NET occupation profile for QA roles lists the specific knowledge domains and education requirements USCIS officers reference. Align your resume and support letter language with those descriptors to reduce the risk of a Request for Evidence.
Ask directly about cap-exempt sponsorship options
Universities, nonprofits affiliated with research institutions, and government research organizations are cap-exempt and can file H-1B petitions year-round outside the lottery. QA roles in these settings are underutilized by applicants focused only on commercial employers.
Start your 60-day grace period clock carefully after layoffs
If your H-1B employer terminates your employment, you have 60 days to secure a new offer and file a transfer petition. Getting a QA contract role during this window doesn't restart the clock, only a new full-time H-1B petition filed with USCIS does.
H-1B Visa Quality Assurance Tester: Frequently Asked Questions
Does a Quality Assurance Tester role qualify as an H-1B specialty occupation?
It can, but the role description matters significantly. USCIS requires that the position normally requires a bachelor's degree in a specific field such as computer science, information systems, or software engineering. QA roles that list only a general degree or treat the degree as optional are more likely to receive a Request for Evidence. Employers strengthen the petition by documenting how the job requires theoretical and technical knowledge beyond what on-the-job training provides.
Which industries sponsor H-1B visas most actively for QA Tester positions?
Software development firms, financial technology companies, healthcare IT vendors, and enterprise SaaS companies file the largest volume of H-1B petitions for QA and software testing roles. Defense contractors and government IT subcontractors also sponsor, and many of those employers are cap-exempt, meaning they can file outside the annual lottery window. You can browse employers by LCA filing history on Migrate Mate to see which companies have active QA sponsorship records.
Can I transfer my H-1B to a new employer if I change QA jobs?
Yes. Under H-1B portability rules, you can begin working for a new employer as soon as the transfer petition is filed with USCIS, without waiting for approval, as long as your previous H-1B was approved and you've maintained valid status. The new employer must file a new I-129 petition and a certified LCA specific to your new role and work location before you start.
What does my employer need to file before sponsoring my H-1B as a QA Tester?
Before submitting the H-1B petition to USCIS, your employer must file a Labor Condition Application with the DOL and receive certification. The LCA certifies that your offered wage meets the prevailing wage for a QA Tester in your work location, determined by the OFLC Wage Search tool. The employer must also post a public notice at your worksite for ten business days before the LCA is submitted.
Does automation testing experience affect how USCIS evaluates my H-1B petition?
Automation testing experience supports the specialty occupation argument because it demonstrates application of programming languages, test frameworks, and software engineering principles that require formal education. If your role involves writing scripts in Python, Java, or Selenium-based tools, that technical specificity helps distinguish the position from manual QA work, which faces more scrutiny. Including automation scope in your job description and support letter can reduce the chance of an RFE.
