Frame your degree for specialty occupation
USCIS requires a direct connection between your degree field and the Sales Executive role. Emphasize coursework in marketing strategy, finance, or industry-specific disciplines on your resume so your employer can document the specialty occupation requirement in the H-1B petition.
Target enterprise software and pharma employers
Enterprise SaaS, medical devices, and financial services companies file H-1B petitions for Sales Executive roles far more consistently than retail or consumer goods firms. Filter your search by industry before applying to avoid employers with no sponsorship history.
Search LCA filings on Migrate Mate before applying
Pull the employer's Labor Condition Application history on Migrate Mate to confirm they've sponsored H-1B workers for sales roles specifically. An LCA for engineering roles doesn't guarantee they'll sponsor yours.
Get your offer letter before the March registration window
USCIS opens H-1B registration in March for an October 1 start date. Your employer needs to register you by the deadline, so secure your offer and align your start date to give payroll and legal teams enough lead time to file.
Verify the employer's prevailing wage tier for your territory
Sales Executive wages vary significantly by region. Use the OFLC Wage Search to check the prevailing wage for your work location before negotiating. Your offer must meet or exceed the DOL wage level the employer certifies on the LCA.
Clarify commission structure in your H-1B petition documents
USCIS scrutinizes variable pay in sales roles. Confirm with your employer that base salary alone meets the prevailing wage threshold and that the petition clearly describes your guaranteed compensation, not on-target earnings.
H-1B Visa Sales Executive: Frequently Asked Questions
Does a Sales Executive role qualify as a specialty occupation for H-1B purposes?
It depends on how the role is defined. USCIS requires that the position normally requires at least a bachelor's degree in a specific field. A Sales Executive role tied to enterprise software, pharmaceuticals, or financial products typically qualifies when the employer documents that technical or industry-specific knowledge is required. Generic account management roles without a degree requirement often don't qualify. The O*NET classification for sales managers can support the specialty occupation argument when your employer builds the petition correctly.
Which industries are most likely to sponsor H-1B visas for Sales Executive roles?
Enterprise technology, life sciences, financial services, and management consulting are the industries that most consistently sponsor H-1B workers in sales roles. These sectors regularly file Labor Condition Applications for Sales Executive and Account Executive titles. Consumer retail and hospitality rarely do. You can browse companies with verified H-1B filing history for sales roles on Migrate Mate before you apply, which saves time and avoids employers who aren't set up to sponsor.
Can my employer sponsor my H-1B if my compensation includes commissions?
Yes, but the base salary must meet the DOL prevailing wage for your job location on its own. USCIS does not count variable commissions toward the required wage. Your employer certifies a specific wage on the LCA, and that figure needs to reflect guaranteed pay. If your offer is structured as a low base plus high commission, confirm with your employer's immigration counsel that the base alone satisfies the prevailing wage before the petition is filed.
What happens to my H-1B status if I change sales territories or get promoted?
A promotion to a new title, a significant change in job duties, or a move to a different work location can require an amended H-1B petition. If your employer moves you to a new metro area, a new LCA certified for that location is required before you start working there. Internal title changes that bring new responsibilities above what the original petition described also typically trigger an amendment. Talk to your employer's immigration team before any role change takes effect.
How far in advance should I start looking for a sponsored Sales Executive role?
Start at least nine to twelve months before you need to begin work. USCIS opens H-1B registration each March for an October 1 start date, and your employer needs time to register you, prepare the LCA, and file the petition after selection. If you're on OPT, factor in your OPT expiration date and whether a cap-gap extension applies. Employers that sponsor regularly will understand this timeline, but smaller companies often need more lead time to engage immigration counsel.
