Verify your role meets specialty occupation standards
USCIS requires that Strategic Business Development positions demand a specific bachelor's degree, not just any degree. Review your offer letter and job description to confirm the role lists a degree requirement in a defined field like business strategy or economics.
Use the OFLC Wage Search before negotiating
Your employer's LCA must certify a wage at or above the prevailing wage for your job's SOC code and metro area. Pull the OFLC Wage Search before your offer conversation so you know the DOL wage floor for your specific location.
Target employers with dedicated BD headcount
Use Migrate Mate to filter for companies with active H-1B LCA filings in business development job codes. Employers who have filed for BD roles before are far more likely to sponsor again than those whose history shows only engineering or technical petitions.
Document business impact with quantified outcomes
USCIS RFEs on BD petitions often challenge whether the role is truly specialized. Build a portfolio of pipeline numbers, partnership revenue, and strategic deliverables that demonstrate the analytical depth distinguishing your work from general sales or account management.
Clarify cap-exempt status with university-affiliated employers
If you're considering a BD role at a university technology transfer office or nonprofit research institution, ask HR directly whether the entity qualifies as cap-exempt. Cap-exempt employers can file outside the annual lottery window, giving you a faster path to status.
Align your O*NET job zone before the LCA is filed
Strategic Business Development maps to O*NET job zones that require bachelor's-level preparation. Confirm with your employer that the SOC code on the LCA matches your actual duties, since a mismatch between the O*NET profile and the job description is a common RFE trigger.
H-1B Visa Strategic Business Development: Frequently Asked Questions
Does a Strategic Business Development role qualify as a specialty occupation for H-1B purposes?
It can, but the role must require a bachelor's degree in a specific field such as business administration, economics, or marketing rather than just any degree. Generalist BD roles that accept any academic background often fail the specialty occupation test. Your employer should document in the I-129 petition why the position demands that specific body of knowledge.
Which employers sponsor H-1B visas for Strategic Business Development roles?
Technology companies, enterprise software firms, management consulting practices, and financial services organizations are the most consistent sponsors for BD roles. These employers typically have dedicated immigration programs and file LCAs regularly for business-side positions. You can search companies with verified H-1B LCA filing history in BD job categories on Migrate Mate.
How does the H-1B lottery affect my timeline for starting a BD role?
If your employer is cap-subject, your petition enters the annual lottery in March and, if selected, employment can begin October 1 of that fiscal year. That gap between offer and start date can be four to seven months. Confirm with your employer whether they'll maintain the offer through that period and whether premium processing is an option to speed up adjudication after selection.
Can I switch from a technical H-1B role to a Strategic Business Development role at the same company?
Yes, but the employer must file an amended H-1B petition with USCIS before you start performing BD duties, since the job duties and SOC code will change materially. The new LCA must reflect the BD role's prevailing wage and the I-129 amendment must document how the new position still meets specialty occupation requirements.
What happens to my H-1B status if my BD role is restructured or eliminated?
You enter a 60-day grace period from your last day of employment to find a new sponsoring employer. During that window, a new employer can file an H-1B transfer petition, and you can begin working for them once the transfer receipt is issued. Acting within the first few weeks of the grace period gives you the most time to secure a new petition before status lapses.
