Align your degree to the SOC code
USCIS approves H-1B petitions for Technical Consultants under SOC codes like 15-1251 or 15-1299. Check O*NET to confirm your degree field matches the listed education requirements before applying, so your employer's LCA filing holds up under scrutiny.
Target consulting firms with cap-exempt clients
Some Technical Consultants are placed at universities or nonprofits that qualify as cap-exempt H-1B employers. If your staffing firm has contracts with those institutions, you may sidestep the annual lottery entirely and file any time of year.
Search verified H-1B sponsors on Migrate Mate
Filter for Technical Consultant roles on Migrate Mate to see which employers have certified LCAs with DOL. That filing history confirms they've already completed the prevailing wage process, which shortens your path from offer to petition.
Request the LCA wage level before signing
Ask your employer which DOL wage level they'll certify on the LCA. Wage Level I applies to entry roles; Level III or IV applies to senior consultants. A mismatch between your offered salary and the certified level can trigger an RFE or denial.
Prepare a specialty occupation evidence file
Consulting roles draw more H-1B RFEs than most tech jobs because the work can seem generalist. Gather job postings, SOW excerpts, and client project scopes that demonstrate the role consistently requires a specific technical degree field, not just broad business knowledge.
Use OFLC Wage Search to benchmark before negotiating
Look up prevailing wages for your metro area and SOC code using OFLC Wage Search before your offer negotiation. Your employer must pay at least the DOL prevailing wage or the actual wage paid to similar workers, whichever is higher.
H-1B Visa Technical Consultant: Frequently Asked Questions
Does a Technical Consultant role qualify as a specialty occupation for H-1B purposes?
Yes, if the position requires at least a bachelor's degree in a specific technical field such as computer science, information systems, or engineering. USCIS evaluates each petition individually, so your employer's job description must tie the daily duties to that specific field. Roles described as generalist or project-management-only face higher RFE rates than those with clearly defined technical requirements.
Which employers sponsor H-1B visas for Technical Consultant jobs?
Enterprise technology companies, consulting firms, and IT staffing agencies are the most active H-1B sponsors for Technical Consultant roles. DOL LCA disclosure data shows consistent filings from firms placing consultants at Fortune 500 clients. Migrate Mate surfaces employers with verified LCA filing histories for this role, so you can focus your applications on companies already set up to sponsor.
Can a staffing agency sponsor my H-1B as a Technical Consultant?
Yes, staffing and consulting firms regularly sponsor H-1B petitions for consultants placed at client sites. USCIS requires the sponsoring employer to maintain an employer-employee relationship, which means the agency must control your work, set your hours, and retain the right to terminate your assignment. Third-party placement arrangements receive additional scrutiny, so your employer will need strong documentation of that control.
What happens to my H-1B if my consulting engagement ends early?
If your employer terminates your H-1B before the approved end date, they are responsible for paying your return transportation costs. You have a 60-day grace period to find a new sponsoring employer, change status, or depart. A new employer can file an H-1B transfer petition during that window, and you can start work once USCIS receives the petition, not after approval.
How does prevailing wage work for Technical Consultant H-1B filings?
Before filing your H-1B petition, your employer must certify a Labor Condition Application with DOL confirming they'll pay at least the prevailing wage for your SOC code and work location. The prevailing wage is determined by DOL wage surveys or a private wage survey the employer submits. You can verify the applicable wage level for your role and metro area using the OFLC Wage Search tool before you negotiate your offer.
