Verify your degree meets specialty occupation standards
Transition of Care roles sit at the intersection of nursing, social work, and health administration. Pull your O*NET profile for this occupation and confirm your degree field directly corresponds to the job's listed education requirements before applying.
Target employers with LCA filing history
Search Migrate Mate to filter Transition of Care roles by employers who have certified Labor Condition Applications with DOL. This tells you which organizations have already cleared the sponsorship infrastructure, not just those that say they're open to it.
Confirm E-Verify enrollment before accepting offers
H-1B employers must be enrolled in E-Verify. Ask HR during late-stage interviews, not after an offer letter arrives. Smaller post-acute or home health employers sometimes lack enrollment, which blocks the petition entirely.
Request prevailing wage documentation from your employer
Your employer's offered wage must meet DOL prevailing wage levels for the exact geographic area of the role. Cross-check their offer against the OFLC Wage Search using the correct Standard Occupational Classification code for care coordination.
Time your application around the H-1B cap filing window
USCIS opens H-1B cap registration each March for an October 1 start date. Transition of Care positions at nonprofit hospitals or government health agencies may qualify as cap-exempt, which lets your employer file outside that window year-round.
Document clinical licensure and care coordination credentials early
Employers filing your H-1B petition need certified copies of any nursing licenses, CCM credentials, or social work certifications upfront. Delays in credential verification are a leading cause of missed USCIS filing deadlines for healthcare petitions.
H-1B Visa Transition Of Care: Frequently Asked Questions
Does a Transition of Care role qualify as a specialty occupation for H-1B purposes?
Yes, provided the position requires at least a bachelor's degree in a specific field such as nursing, social work, health administration, or a related clinical discipline. Generalist roles where any degree suffices typically don't qualify. Employers strengthen the petition by documenting that the complexity of care coordination across settings demands specialized academic training.
Which types of employers sponsor H-1B visas for Transition of Care positions?
Hospital systems, integrated health networks, managed care organizations, and home health agencies are the most active sponsors. Nonprofit hospitals and federally qualified health centers often qualify as cap-exempt H-1B employers, meaning they can file petitions year-round without waiting for the annual lottery. Use Migrate Mate to identify employers in this role category who have active LCA filing history.
How does the H-1B prevailing wage requirement apply to Transition of Care jobs?
DOL requires your employer to pay at least the prevailing wage for your specific occupation and work location, determined by the OFLC Wage Search. For care coordination roles, the applicable wage level depends on your job duties and whether the position maps to a nursing, social work, or health administration occupational code, so the exact figure varies by geography and role definition.
Can I transfer my H-1B to a new Transition of Care employer if I switch jobs?
Yes. Under H-1B portability rules, you can start working for a new sponsor as soon as the new petition is filed with USCIS, without waiting for approval, as long as you're maintaining valid H-1B status. The new employer must file a transfer petition, obtain a fresh LCA certification from DOL, and confirm the role still meets specialty occupation standards.
What documents should I gather before a Transition of Care employer files my H-1B petition?
You'll need academic transcripts and degree certificates, any active clinical licenses such as an RN license or LCSW, professional credential certifications like a CCM, and your current I-94 record. Employers also need your complete employment history if prior H-1B status is being carried over. Assembling these before the petition process starts prevents delays during the USCIS filing window.
