Verify your degree field matches the role
The H-1B1 visa requires a specialty occupation, so a general business degree may not satisfy consular officers for complex real estate analyst or asset management roles. Pull the O*NET occupation profile for your target job title and confirm the standard entry-level education listed aligns with your credential.
Target employers with active LCA filing history
Real estate firms that have filed Labor Condition Applications before understand the H-1B1 Chile process and won't stall at the LCA stage. Search Migrate Mate to filter for employers with verified H-1B1 sponsorship history in real estate and property management roles.
Confirm the employer understands LCA certification timelines
DOL certifies LCAs within seven business days, but employers unfamiliar with the process often delay because they confuse it with the full USCIS H-1B visa petition timeline. When negotiating your start date, clarify with HR that the LCA is the only employer-side filing required before your consular appointment.
Check prevailing wage requirements before salary negotiations
Your offered salary must meet or exceed the DOL prevailing wage for your specific real estate role and work location. Run the OFLC Wage Search using your job's SOC code before finalizing any offer so you can flag a shortfall before the LCA is submitted, not after.
Prepare documentation that demonstrates specialty occupation status
Chilean consular officers scrutinize whether real estate roles qualify as specialty occupations. Bring a detailed job description, your degree transcript with English translation, and any Chilean professional licensing credentials to show the position requires your specific academic background, not generalist real estate experience.
Time your consular appointment around the Chilean fiscal year
The H-1B1 Chile cap resets each October 1, and the 1,400 annual slots rarely fill, so scheduling flexibility is yours year-round. Avoid booking consular appointments at the U.S. Embassy in Santiago during late December through January, when staffing and scheduling slots are reduced due to Chilean and U.S. holidays.
Frequently Asked Questions
Do Real Estate jobs qualify as specialty occupations for the H-1B1 Chile visa?
Real estate roles qualify when the position genuinely requires at least a bachelor's degree in a specific field such as real estate, finance, urban planning, or business administration. General property management or leasing agent roles that accept any background typically do not qualify. Roles like real estate analyst, asset manager, or commercial acquisitions associate are stronger candidates because the degree requirement is defensible at the consular interview.
How does the H-1B1 Chile visa differ from the H-1B for Real Estate professionals?
The H-1B1 Chile visa has no lottery and a 1,400-visa annual cap that has never been exhausted, so a qualified Chilean real estate professional with a job offer can proceed to a consular appointment without the uncertainty of an April lottery draw. The tradeoff is that the H-1B1 doesn't allow dual intent, meaning you can't use it as a stepping stone to a green card the way some H-1B holders do.
What employer filing steps are required before my consular appointment?
Your employer must file a Labor Condition Application with DOL and receive certification before you can apply at the consulate. DOL certifies LCAs within seven business days. There is no USCIS petition for H-1B1 Chile, which means the employer-side process is significantly shorter than a standard H-1B. Once the certified LCA is in hand, you schedule your interview at the U.S. Embassy in Santiago.
How do I find Real Estate employers who will sponsor an H-1B1 Chile visa?
Most real estate firms haven't heard of the H-1B1 Chile visa specifically, so targeting employers with prior LCA filing history in real estate or property management is the fastest path to a sponsoring employer. Migrate Mate lets you filter job listings by employers who have already filed H-1B1 Labor Condition Applications, so you're not cold-pitching the process to HR from scratch.
Can I switch real estate employers while on H-1B1 Chile status?
Yes, but your new employer must file and receive a certified LCA before you begin working for them. Unlike H-1B portability rules, there is no provision allowing you to start work with a new employer once an LCA is pending. Plan your transition so the new LCA is fully certified and your consular documentation is updated before your last day with the prior employer.
