Translate your credentials into U.S. specialty occupation framing
Your Chilean degree title may not map cleanly to U.S. equivalents. Get a credential evaluation that confirms your degree satisfies the specialty occupation standard for VP Product roles, referencing the O*NET profile for Computer and Information Systems Managers.
Target employers with active LCA filing history
Search Migrate Mate to filter companies that have filed Labor Condition Applications for product management roles. This history signals that the employer understands H-1B1 Chile sponsorship mechanics and won't need educating during offer negotiations.
Distinguish H-1B1 from H-1B during employer conversations
Many U.S. hiring managers conflate the two visas. Tell them directly: H-1B1 Chile requires no lottery, no USCIS petition, and processes in weeks at the consulate. This removes the cap anxiety that causes employers to deprioritize international candidates.
Confirm your offer letter meets DOL prevailing wage requirements
Before signing, cross-check your offered total compensation against the OFLC Wage Search for the VP Product or Computer and Information Systems Managers SOC code in your work location. Your employer's LCA must certify this wage, and it's easier to correct before the offer is countersigned.
Build a consular-ready document package before your start date
The H-1B1 Chile consulate application requires a certified LCA, detailed offer letter, and proof of your specialty occupation qualifications. Prepare certified degree translations and a credentials evaluation so you can schedule your appointment the day the LCA clears DOL.
Negotiate the employer's role in the LCA filing process
The LCA is an employer obligation under DOL rules, not optional. During offer negotiation, confirm the hiring company will file the LCA promptly and maintain a public access file. Delays at this step are the most common reason H-1B1 Chile timelines slip for VP-level hires.
Frequently Asked Questions
Does a VP Product role qualify as a specialty occupation for the H-1B1 Chile visa?
Yes. VP Product roles typically require a bachelor's degree or higher in computer science, engineering, business, or a related field, satisfying the specialty occupation definition. The O*NET profile for Computer and Information Systems Managers confirms the degree requirement. Your employer documents this in the Labor Condition Application they file with DOL before your consulate appointment.
How is the H-1B1 Chile visa different from the H-1B for a VP Product hire?
The H-1B1 Chile visa has no lottery and bypasses USCIS entirely. Your employer files a Labor Condition Application with DOL, then you apply directly at the consulate with that certified LCA. The annual cap is 1,400 visas and has never been exhausted, so there's no selection uncertainty. H-1B petitions go through USCIS and enter an oversubscribed lottery, often making timeline planning difficult for both parties.
How do I find companies actively sponsoring H-1B1 Chile visas for VP Product positions?
Use Migrate Mate to search for employers with verified Labor Condition Application filing history in product management and technology leadership roles. LCA disclosure data shows which companies have sponsored similar positions before, so you can focus your outreach on employers already familiar with the H-1B1 Chile process rather than ones you'd need to educate from scratch.
Can I stay in the U.S. while my employer files a new LCA if I change companies as a VP Product?
The H-1B1 Chile visa doesn't carry the same portability provisions as H-1B. If you change employers, your new company must obtain a certified LCA and you'll need a new visa stamp before returning to the U.S. after any international travel. Plan any employer transitions carefully around your travel schedule and ensure the new LCA is certified before you depart the country.
What should my employer include in the offer letter to support the H-1B1 Chile consulate application?
Your offer letter must specify your job title, the specialty occupation duties tied to your degree field, your work location, your start date, and that the position is full-time and non-temporary. Consular officers look for a clear link between your VP Product responsibilities and your academic credentials. Vague offer letters that list generic management duties without referencing the technical or analytical nature of the role are a common reason for requests for additional evidence.
