Head Of Technology Jobs in USA with Visa Sponsorship
Head of Technology roles attract H-1B, O-1A, and L-1A visa sponsorship from U.S. employers, particularly in tech, finance, and healthcare. Executives leading engineering or product organizations often qualify for priority worker or extraordinary ability classifications, which bypass the H-1B lottery entirely. For detailed occupation requirements, see the O*NET profile.

How to Get Visa Sponsorship in Head Of Technology
Position yourself as a strategic leader, not just a technical one
Employers sponsoring a Head of Technology need to justify the role requires specialized expertise at the executive level. Document your P&L ownership, team size, and cross-functional influence to strengthen the specialty occupation and executive classification arguments.
Explore O-1A if you have industry recognition
If you've spoken at major conferences, published technical work, led award-winning teams, or been cited in industry media, you may qualify for an O-1A visa. It has no annual cap, no lottery, and is frequently approved for senior technology executives.
Target companies with established immigration programs
Large technology, financial services, and healthcare employers typically have in-house immigration counsel and predictable sponsorship pipelines. These organizations process H-1B and L-1 petitions routinely, reducing approval risk and administrative friction compared to first-time sponsors.
L-1A is viable if you're transferring within a multinational
Heads of Technology moving from a foreign parent, subsidiary, or affiliate to a U.S. entity qualify for the L-1A intracompany transferee visa. It requires one year of qualifying employment abroad and directly supports an EB-1C green card pathway afterward.
Document your team's size, budget, and organizational scope
For both H-1B specialty occupation and L-1A managerial classification, USCIS scrutinizes whether the role genuinely requires executive-level authority. Org charts, budget responsibility documentation, and board-level reporting relationships materially strengthen your petition.
Start sponsorship conversations before accepting an offer
H-1B cap-subject petitions are filed in April for an October start date. If you're not already in H-1B status or cap-exempt, timing matters significantly. Raising visa requirements early prevents mismatched expectations and allows employers to plan around filing deadlines.

What visas can sponsor a Head of Technology role in the U.S.?
The most common options are the H-1B, O-1A, and L-1A. The H-1B applies broadly to specialty occupations requiring a bachelor's degree or higher in a specific field. The O-1A suits executives with demonstrable industry recognition, while the L-1A applies to intracompany transferees in managerial or executive roles. You can browse Head of Technology roles with active sponsorship on Migrate Mate.
Does a Head of Technology role qualify as a specialty occupation for H-1B purposes?
Generally yes, but the role definition matters. USCIS requires that the position normally requires a bachelor's degree or higher in a specific specialty such as computer science, information systems, or engineering management. Roles framed purely as general management without a technical degree requirement face higher scrutiny. A well-drafted job description tying the role's duties to specific technical disciplines significantly reduces RFE risk.
What degree is typically required for H-1B sponsorship as a Head of Technology?
A bachelor's degree or higher in computer science, information technology, electrical engineering, or a closely related field is the standard. Advanced degrees in business combined with an undergraduate technical degree are also accepted. Equivalent experience can substitute under the three-for-one rule, where three years of progressive technical experience replaces one year of formal education, though documentation requirements are stricter.
Can a Head of Technology qualify for an EB-1 green card without employer sponsorship?
Yes, through the EB-1A extraordinary ability category, which is self-petitioned and requires no employer sponsor. Qualifying evidence includes major awards, press coverage, high compensation relative to peers, judging others' work, and authorship of influential technical publications. Heads of Technology with significant industry profiles, patents, or executive leadership at well-known companies are strong candidates. An immigration attorney can assess your evidence before filing.
How competitive is H-1B sponsorship for senior technology executive roles?
Senior roles fare better than mid-level positions because employers have stronger business justification and are more willing to invest in legal fees and premium processing. However, cap-subject H-1B petitions still enter the annual lottery regardless of seniority. Many Heads of Technology pursue O-1A or L-1A pathways specifically to avoid the lottery. USCIS approval rates for properly documented specialty occupation petitions in technology remain above 85%.
What is the prevailing wage requirement for sponsored Head Of Technology jobs?
U.S. employers sponsoring a visa must pay at least the prevailing wage, which is what workers in the same role, area, and experience level typically earn. The Department of Labor sets this rate to make sure companies aren't hiring foreign workers simply because they'd accept lower pay than a U.S. worker. It varies by job title, location, and experience. You can look up current prevailing wage rates for any occupation and location using the OFLC Wage Search page.
