Target employers with H-1B filing history
Large hospital systems, federally qualified health centers, and VA facilities have established immigration infrastructure and sponsor mental health professionals regularly. Smaller private practices rarely have the resources or legal support to file H-1B petitions.
Confirm your state license is transferable
Each state issues its own clinical license, and requirements vary significantly. Verify that your home-country credentials are eligible for licensure in your target state before accepting an offer, since employers sponsor the position, not just the person.
Clarify the degree requirement in the job listing
H-1B specialty occupation approval depends on the role requiring a specific degree. If a listing says a master's is preferred but not required, that weakens the petition. Look for postings that explicitly require a master's in counseling, social work, or psychology.
Ask about cap-exempt employer options
Nonprofit mental health agencies affiliated with universities or research institutions may qualify as cap-exempt H-1B employers. This means they can file year-round without waiting for the April lottery, which significantly reduces your timeline to authorization.
Get your foreign credentials evaluated early
If you trained outside the United States, a credential evaluation from a NACES-approved organization is required for both state licensure and the H-1B petition. Starting this process before you apply saves weeks and prevents offer delays.
Understand the timeline between offer and start date
H-1B petitions for cap-subject employers are filed in April with an October 1 start date. Factor in USCIS processing time when negotiating your start date, and ask whether the employer will pay for premium processing to accelerate the decision.

Find Licensed Mental Health Professional JobsFrequently Asked Questions
Does a Licensed Mental Health Professional role qualify for H-1B sponsorship?
Yes, licensed mental health roles including LCSWs, LPCs, LMFTs, and licensed psychologists generally qualify as H-1B specialty occupations because they require at least a master's degree in a specific clinical field. USCIS has approved H-1B petitions for these roles consistently, particularly when the job listing explicitly requires a graduate-level degree and the employer is a hospital, health system, or established nonprofit provider.
Which employers most commonly sponsor mental health professionals for visas?
Large hospital networks, federally qualified health centers, Veterans Affairs facilities, university counseling centers, and nonprofit behavioral health organizations are the most active H-1B sponsors for mental health roles. These employers have dedicated HR and legal teams experienced with immigration petitions. Migrate Mate lets you filter sponsorship-friendly mental health job listings so you can focus applications on employers with a documented history of sponsoring this role.
Do I need a U.S. state license before my employer can file an H-1B petition?
Not necessarily at the time of filing, but you must hold a valid state license before you can legally practice. Many employers will file the H-1B petition while you are completing the state licensure process, as long as the license is in place by your start date. Some states offer provisional or supervised licensure, which can bridge the gap while your full license application is pending.
Can my foreign master's degree in counseling or psychology support an H-1B petition?
Yes, but it needs to be evaluated by a NACES-approved credential evaluation agency to confirm it is equivalent to a U.S. master's degree. A three-year or four-year graduate program from Australia, the UK, Canada, India, or most other countries can satisfy the degree requirement when properly evaluated. Without this evaluation, neither your state licensing board nor your employer's immigration attorney can verify the credential for petition purposes.
What is the H-1B lottery and how does it affect mental health job seekers?
Most H-1B petitions are subject to an annual cap of 85,000 slots, selected by random lottery each April for an October 1 start date. If your registration is not selected, you cannot start that year under H-1B. Cap-exempt employers, including many nonprofit hospitals and university-affiliated clinics, can file outside the lottery. Prioritizing cap-exempt employers significantly reduces uncertainty if you are on OPT, in a grace period, or need authorization quickly.
What is the prevailing wage requirement for sponsored Licensed Mental Health Professional jobs?
U.S. employers sponsoring a visa must pay at least the prevailing wage, which is what workers in the same role, area, and experience level typically earn. The Department of Labor sets this rate to make sure companies aren't hiring foreign workers simply because they'd accept lower pay than a U.S. worker. It varies by job title, location, and experience. You can look up current prevailing wage rates for any occupation and location using the OFLC Wage Search page.
