How to Get Visa Sponsorship in Corporate Legal Counsel
Confirm your bar admission status early
Many employers require active U.S. bar admission or eligibility to waive in. Clarify this before applying, as sponsorship timelines depend on whether you need additional licensing steps alongside visa filing.
Use your foreign law experience strategically
If you practiced law abroad, frame that expertise as a differentiator, particularly for multinational employers. Cross-border regulatory knowledge is genuinely valuable and can make sponsorship feel like a business investment rather than a burden.
Understand how your J.D. or foreign law degree maps to USCIS requirements
USCIS requires a bachelor's degree or higher in a specific specialty field. A J.D. from an ABA-accredited school satisfies this. Foreign law degrees may require credential evaluation to confirm U.S. equivalency before filing.
Consider the O-1A if you have a strong professional track record
Corporate counsel with published work, leadership in legal associations, or notable case outcomes may qualify for the O-1A. It bypasses the H-1B lottery entirely and is worth evaluating if your credentials are exceptional.
Negotiate sponsorship terms before signing an offer
Confirm whether the employer covers H-1B filing fees, premium processing, and legal counsel costs. These details vary significantly and affect your out-of-pocket exposure during the sponsorship process.

Does a Corporate Legal Counsel role qualify as a specialty occupation for H-1B purposes?
Yes. Corporate Legal Counsel positions require a J.D. or equivalent law degree and typically active bar admission, which satisfies the H-1B specialty occupation standard. USCIS has consistently recognized legal roles as qualifying. The key is that the employer's job description must make the degree requirement explicit and tied directly to the duties performed.
Do I need to be licensed to practice law in the U.S. before my employer can sponsor me?
Not necessarily at the time of filing, but many employers require you to be licensed or eligible to waive into a state bar before you start. Some roles are structured as 'legal advisor' positions that don't require active bar admission, which can create more flexibility. Clarify the specific job requirements with the employer before assuming your license status disqualifies you.
Can employers sponsor Corporate Legal Counsel roles for the H-1B if the attorney graduated from a foreign law school?
Yes, but it requires a credential evaluation. USCIS needs confirmation that the foreign law degree is equivalent to a U.S. bachelor's degree or higher in law. A credential evaluation from a recognized agency like NACES handles this. Foreign-trained attorneys who also passed a U.S. bar exam (such as New York's) are generally in a stronger position for both sponsorship and employment.
What are my visa options if I miss the H-1B lottery as a Corporate Legal Counsel?
The O-1A is the most practical alternative if you have a strong track record, such as published legal analysis, leadership in bar associations, or recognition in your field. TN status is available for Canadian and Mexican attorneys. Some employers will also explore the L-1 if you're transferring from a related entity abroad. Browse open Corporate Legal Counsel roles on Migrate Mate to find employers who have sponsored these alternatives.
How long does H-1B sponsorship typically take for in-house legal roles?
Standard H-1B processing runs three to six months after USCIS receives the petition. Premium processing reduces that to 15 business days for an initial decision. Most large employers with in-house legal teams use premium processing to reduce uncertainty. If you're already in the U.S. on another valid status, you can often continue working while the H-1B is pending, depending on your current visa category.
What is the prevailing wage requirement for sponsored Corporate Legal Counsel jobs?
U.S. employers sponsoring a visa must pay at least the prevailing wage, which is what workers in the same role, area, and experience level typically earn. The Department of Labor sets this rate to make sure companies aren't hiring foreign workers simply because they'd accept lower pay than a U.S. worker. It varies by job title, location, and experience. You can look up current prevailing wage rates for any occupation and location using the OFLC Wage Search page.
