Confirm your degree field matches the role
USCIS requires a bachelor's degree in computer science, information systems, or a closely related field for specialty occupation approval. A business or general technology degree can trigger an RFE, so verify alignment before applying.
Target consulting firms with established immigration infrastructure
Large consulting employers like Deloitte, Accenture, and Infosys file thousands of H-1B petitions annually. Their in-house immigration teams process sponsorship faster and with fewer complications than smaller firms handling their first petition.
Understand that consulting has unique LCA considerations
Because consultants often work at client sites, employers must file a Labor Condition Application covering each worksite location. Ask whether your offer letter accounts for this, as mismatches can delay your petition or create compliance issues.
Ask about cap-exempt sponsorship pathways
Some consulting roles placed at universities, nonprofits, or government research facilities qualify for cap-exempt H-1B petitions. These bypass the annual lottery entirely, giving you a direct path to status without waiting for the April selection.
Prepare a clear narrative linking your degree to your duties
USCIS scrutinizes consultant petitions closely. A strong support letter detailing how your specific academic background applies to the client deliverables and technical scope of your role significantly reduces the chance of a Request for Evidence.
Browse Migrate Mate for roles with confirmed sponsorship history
Not every consulting job listing will state sponsorship availability upfront. Migrate Mate filters for employers with verified sponsorship records, so you spend less time chasing dead ends and more time on applications that can actually move forward.
Frequently Asked Questions
Does Software Consultant qualify as a specialty occupation for H-1B purposes?
Yes, Software Consultant is a well-established specialty occupation under USCIS policy, provided the role requires theoretical and practical application of computer science or a related discipline. The petition is stronger when the job description specifies technical deliverables rather than general advisory duties. Vague or broad consulting scopes are the most common reason for Requests for Evidence on this title.
Can I get sponsored as a Software Consultant without a computer science degree?
It depends on your specific degree. A degree in information technology, software engineering, or management information systems generally supports approval. A degree in business, accounting, or an unrelated field is harder to defend unless your coursework heavily overlaps with the technical requirements of the role. In that case, employers often use a credential evaluation or supplementary documentation to bridge the gap.
Do consulting firms sponsor for green cards, or only temporary work visas?
Many large consulting employers sponsor both. H-1B visa is the standard entry point, and after one to three years, firms with established immigration programs will begin PERM labor certification for EB-2 or EB-3 green card sponsorship. Smaller or boutique consulting firms may only commit to H-1B and leave green card sponsorship as a case-by-case decision. Ask directly during the offer stage.
Why do Software Consultant H-1B petitions get higher RFE rates than other tech roles?
USCIS applies extra scrutiny to consulting titles because the work is often performed at third-party client sites rather than the petitioning employer's location. Officers sometimes question whether a bona fide employer-employee relationship exists and whether the specialty occupation requirement genuinely applies to every client engagement. Detailed itineraries, specific project descriptions, and strong support letters from both the employer and the end client reduce this risk significantly.
Where can I find Software Consultant jobs that actually offer visa sponsorship?
Migrate Mate is built specifically for this. It aggregates Software Consultant roles from employers with verified H-1B and other sponsorship histories, so you can filter by visa type and skip the guesswork of cold-applying to companies that quietly don't sponsor. For international candidates on OPT or in their 60-day grace period, narrowing to confirmed sponsors saves weeks of wasted applications.
What is the prevailing wage requirement for sponsored Software Consultant jobs?
U.S. employers sponsoring a visa must pay at least the prevailing wage, which is what workers in the same role, area, and experience level typically earn. The Department of Labor sets this rate to make sure companies aren't hiring foreign workers simply because they'd accept lower pay than a U.S. worker. It varies by job title, location, and experience. You can look up current prevailing wage rates for any occupation and location using the OFLC Wage Search page.
