How to Get Visa Sponsorship in Senior Software Engineering
Target employers with a strong H-1B filing history
Companies that have sponsored software engineers before are far more likely to do it again. Look for employers with consistent H-1B filing records in OFLC disclosure data, repeated filings in your job category signal an established, familiar process.
Make sure your degree field matches the role
H-1B specialty occupation requires a direct connection between your degree and the position. Computer science, software engineering, or information systems degrees map cleanly. A general business degree, even paired with coding experience, can create complications at adjudication.
Highlight specialized technical skills in your application
USCIS scrutinizes senior-level software roles for specialty occupation eligibility. Emphasizing niche expertise, distributed systems, machine learning infrastructure, or platform engineering, strengthens the case that the position requires specific theoretical knowledge.
Understand the H-1B lottery timeline before accepting offers
Cap-subject H-1B registration opens in March for an October start. If you miss the lottery, ask about cap-exempt employers like universities or nonprofits, or explore options like the O-1A for candidates with documented technical recognition.
Ask employers directly about their sponsorship process
Some companies sponsor but have slow internal approval chains. During interviews, ask whether the company uses in-house immigration counsel or outside firms, and how long their typical H-1B petition process takes from offer to filing.
Keep your immigration documents current if transferring employers
Changing employers on H-1B requires a new I-129 petition with portability protections if your I-485 is pending. Start the transfer process before your last day, working even briefly without an approved or pending transfer petition creates unauthorized employment.

Get Access To All JobsFrequently Asked Questions
Do Senior Software Engineering roles qualify as H-1B specialty occupations?
Yes, software engineering consistently qualifies as a specialty occupation under USCIS standards. The role requires theoretical and practical application of highly specialized knowledge, and a bachelor's degree or higher in a specific technical field is the standard industry requirement. USCIS approval rates for software-related H-1B petitions have remained among the highest of any occupation category, though roles with vague job duties or generic degree requirements can face Requests for Evidence.
What degree do I need for H-1B sponsorship as a Senior Software Engineer?
A bachelor's degree or higher in computer science, software engineering, information technology, or a closely related field is the standard requirement. Degrees in unrelated fields paired with years of experience are harder to defend at adjudication. If you hold a three-year degree from a foreign institution, a credential evaluation confirming equivalency to a U.S. four-year bachelor's degree is typically required before the employer can file.
Can I get sponsored as a Senior Software Engineer without going through the H-1B lottery?
Yes. Several cap-exempt pathways apply. Universities, nonprofit research institutions, and government research organizations are exempt from the H-1B cap and can file year-round. Candidates with patents, significant open-source contributions, conference presentations, or published research may qualify for the O-1A visa, which requires no lottery. Australians with a qualifying bachelor's degree and a U.S. job offer should also evaluate the E-3 visa, which has its own separate annual allocation.
How do I find Senior Software Engineering jobs that actually offer visa sponsorship?
Most job postings don't state sponsorship availability clearly, which makes filtering difficult on general platforms. Migrate Mate focuses specifically on roles where sponsorship is confirmed or highly probable, so you're not spending time on applications that will stall at the HR stage. Searching by role and filtering for sponsorship-indicated employers saves significant time, especially when you're working against an OPT or grace period deadline.
Does seniority level affect H-1B approval odds for software engineers?
Senior-level roles can actually strengthen an H-1B petition because the job description is more likely to articulate specialized requirements, specific tech stacks, system architecture ownership, or domain expertise, that support the specialty occupation argument. Entry-level software roles sometimes face more scrutiny because the duties can appear general. For senior positions, the employer's support letter and job description should clearly document the complexity and specialized knowledge the role demands.
What is the prevailing wage requirement for sponsored Senior Software Engineering jobs?
U.S. employers sponsoring a visa must pay at least the prevailing wage, which is what workers in the same role, area, and experience level typically earn. The Department of Labor sets this rate to make sure companies aren't hiring foreign workers simply because they'd accept lower pay than a U.S. worker. It varies by job title, location, and experience. You can look up current prevailing wage rates for any occupation and location using the OFLC Wage Search page.
