H-1B Sponsorship Jobs

The H-1B is the most common work visa for international professionals in the U.S., covering specialty occupations that require at least a bachelor's degree. Employers file petitions on behalf of candidates, and most new H-1B visas are subject to an annual cap of 85,000, with a lottery selection held each April. Cap-exempt employers, including universities and nonprofit research institutions, can file at any time.

How to Get H-1B Sponsorship

Target employers with a proven sponsorship track record

Large tech companies, consulting firms, and financial institutions sponsor H-1B workers at the highest rates. Look for employers who have filed H-1B petitions in prior years, as repeat sponsors understand the process and are far less likely to back out.

Apply well before the April lottery deadline

USCIS opens H-1B registration in March for an October 1 start date. Most employers need several months to prepare petitions, so securing a job offer by January or February gives your employer enough lead time to register you.

Understand that the lottery is the biggest obstacle

H-1B selection is randomized. In recent years, only about one in four registrations was selected. Applying through multiple qualifying employers, if your situation allows, increases your chances of at least one selection.

Cap-exempt employers let you bypass the lottery entirely

Universities, nonprofit research organizations, and government research institutions are exempt from the annual H-1B cap. A role at one of these employers means no lottery, no April deadline, and year-round filing eligibility.

Specialty occupation eligibility depends on your specific role

H-1B approval requires the position to qualify as a specialty occupation, meaning it normally requires a bachelor's degree in a specific field. Ensure your job offer letter clearly describes duties that align with your degree before your employer files.

OPT or STEM OPT buys you critical runway

If you're an F-1 graduate, OPT lets you work while waiting for H-1B selection. STEM OPT extends that to three years, covering multiple lottery cycles and giving you more time to secure a sponsoring employer.

Frequently Asked Questions

How does the H-1B lottery work?

USCIS opens H-1B registrations in March each year. Employers register candidates electronically, and if demand exceeds the 85,000 annual cap, a random lottery selects which registrations proceed to full petition filing. Those with a U.S. master's degree or higher get a separate lottery pool that increases their selection odds slightly before any remaining slots go to the general pool.

Which employers are exempt from the H-1B cap?

Universities, affiliated nonprofit entities, nonprofit research organizations, and government research agencies are cap-exempt, meaning they can sponsor H-1B workers year-round without waiting for the April lottery. Jobs at these institutions often go unfilled because candidates focus only on cap-subject roles, making them an overlooked but reliable path to H-1B sponsorship.

How long does an H-1B visa last?

An initial H-1B is granted for three years and can be extended for another three, giving a maximum of six years. After that, further extensions are available if an employer has filed a green card petition on your behalf and certain milestones have been reached. Workers from countries with long green card backlogs often remain on H-1B extensions for many years while waiting.

How to find H-1B sponsorship jobs?

Migrate Mate lets you filter jobs by visa type to see which employers are actively sponsoring H-1B workers right now. Focus on companies with established immigration legal teams, typically those with over 500 employees. Staffing agencies that specialize in international placements can also sponsor H-1B workers, particularly in technology, consulting, and engineering.

Can I change jobs while on an H-1B?

Yes. Under H-1B portability rules, you can start working for a new employer as soon as they file an H-1B transfer petition, without waiting for approval, as long as you have been in valid H-1B status for at least 180 days. The new job must still be a qualifying specialty occupation. Your visa remains tied to the employer, so the new company must file on your behalf.

What is the prevailing wage for h-1b sponsorship jobs?

U.S. employers sponsoring a visa must pay at least the prevailing wage, which is what workers in the same role, area, and experience level typically earn. The Department of Labor sets this rate to make sure companies aren't hiring foreign workers simply because they'd accept lower pay than a U.S. worker. It varies by job title, location, and experience. You can look up current prevailing wage rates for any occupation and location using the OFLC Wage Search page.
